These Terms of Use govern your use of kuumbapro.org, the Joy Up™ mobile application, and materials published by Kuumba, LLC (“Kuumba,” “we,” “us”), including the free guide. By using any of them you agree to these terms. If you do not agree, please do not use them.

This is not medical or mental health care

Joy Up™ is a general wellness and personal reflection practice. It is not medical care, mental health care, therapy, or a medical device. It does not provide medical advice, diagnosis, or treatment, and it does not replace clinical care or crisis intervention.

The practice involves breathing, gentle movement, and voluntary laughter. Stop immediately if you feel pain, dizziness, lightheadedness, or shortness of breath. Read the full disclaimer, including who should speak with a doctor first, before you practice.

If you are experiencing a medical emergency, thoughts of harming yourself or others, or distress that feels unmanageable, stop and get help now. In the United States, call or text 988, or call 911.

You are responsible for practicing somewhere safe. Do not practice while driving or operating machinery, and stay aware of your surroundings if you practice outdoors.

Who may use this

You must be 13 or older. If you are under 18, you may use it only with the involvement of a parent or guardian. By using it you confirm you meet these requirements.

Our content belongs to us

Everything on this site and in the app, including text, the guide, images, video, audio, and design, is owned by Kuumba, LLC or used with permission, and is protected by copyright and other laws.

What you may do

Use the practice yourself, freely, for as long as you like.
Share the free guide as we distribute it, unchanged and with attribution intact.
Quote briefly with credit to Dr. Harvey Hinton III and Kuumba, LLC.

What you may not do

Sell, license, or charge for our materials.
Teach, train, or certify others in Joy Up™ or The JEBBEDIAH Way as though authorized by us, without a written agreement.
Remove trademark, copyright, or attribution notices.
Present our frameworks as your own, or create derivative frameworks from them.
Scrape, bulk download, or use our content to train a machine learning model.

Laughter Yoga

Laughter Yoga is a trademark of Laughter Yoga International Foundation and Laughter Yoga University. Dr. Hinton is a Certified Laughter Yoga Leader, and any Laughter Yoga sessions he offers are offered in that capacity. Joy Up™ incorporates intentional laughter but is a separate practice, distinct in purpose and application, and is not Laughter Yoga.

Engagements, bookings, and fees

Scheduling a discovery call does not create a contract for services. Every engagement is scoped to the organization it is built for, and any fee is agreed separately in writing. Nothing on this site is an offer, a quote, or a guarantee of availability.

If you give us your email, you are asking us to send you the guide and the weekly email. You can unsubscribe at any time from any message.

The app and purchases

The Joy Up app is distributed through the Apple App Store and Google Play. Purchases and subscriptions are handled by those stores under their terms, and refunds are governed by their policies, not ours. We grant you a personal, non-transferable, revocable license to use the app for your own use.

No guarantees

The site, the app, and the guide are provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that they will be uninterrupted, error free, or that they will produce any particular result.

Individual experiences vary. Nothing here promises a specific outcome for your health, your wellbeing, your leadership, or your organization.

Limitation of liability

To the fullest extent permitted by law, Kuumba, LLC and Dr. Harvey Hinton III will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of your use of the site, the app, the guide, or the practice. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim, or one hundred United States dollars, whichever is greater.

Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.

You accept the risk of the practice

You choose to practice voluntarily and you accept responsibility for doing so safely, having read the disclaimer and considered your own health. If you have any condition listed there, speak with your doctor first.

Links to other sites

We link to other sites, including video and podcast platforms. We do not control them and we are not responsible for their content or their privacy practices.

Changes and ending access

We may change these terms, and we may change or discontinue any part of the site or app. Material changes will be posted here with an updated date. We may suspend access for anyone who misuses the site, the app, or our content.

Governing law

These terms are governed by the laws of the state in which Kuumba, LLC is organized, without regard to its conflict of laws rules.
